Judgments

Each judgment on this web site contains a Judicial Officer's reasons for his or her decision in a case. Since May 1999, judgments of this court have been cited using the names of the parties, the year, the court's designation and the number of the judgment. For example, Re Purdue; ex parte Kennedy [1999] WASC 1 is the first decision of the Western Australian Supreme Court in 1999 to use this form of citation. All Australian Courts use this form of citation.

The court publishes the majority of its decisions from 1991 onwards on this site. If you want to find, read or print the text of a particular judgment published during this period, use the search options on this page.

A judgment with a PA appearing next to the citation (e.g. PA [2012] WASC 98) means that the matter is pending an appeal, while a judgment with a R appearing next to the citation (e.g. R [2009] WASCA 165) means that the judgment has been reported.

If you believe that a particular judgment has been delivered during this period but you cannot find it on this site, the publication of the judgment may have been suppressed. Very few judgments are suppressed but it may occur, for example, to prevent prejudice to forthcoming trials or because legislation prevents the publication of certain information contained in the judgment.

Judgments may also be edited to ensure that they comply with any suppression orders and legislative restrictions regarding publications. In addition, judgments may be edited where publication may have an adverse impact on victims, witnesses or other persons connected with the proceedings.
