On the application heard before Member Tim Carey on 26 August 2015, it is by consent ordered that:
1. The decision of the respondent to refuse to grant approval for the applicant to keep bee hives on his residential property at 54 Mariners View, Mindarie (the property) is set aside.
2. The Tribunal grants approval to the applicant to allow him to keep two bee hives on the applicant's property for 12 months from the date of this order on the following conditions:
(a) the hives must be located as near as practicable to the retaining wall traversing the rear of the applicant's property on the lower level approximately 10 metres from the southern boundary fence;
(b) the hives are to face east at their highest point;
(c) the hives when installed are to be no more than two metres high; and
(d) the hives are to be surrounded by a shade cloth screen forming an area no greater than four square metres. |
